Petite Pants Club Regulations
§ 1 GENERAL PROVISIONS
- This Regulations defines the rules of the "Petite Pants Club" Loyalty Program operating within the www.petitepants.pl Online Store.
- The Organizer of the Loyalty Program is TBE Company Sp. z o.o., with its registered office at: ul. Jodłowa 3/5, 81-526 Gdynia, NIP 9562367791, REGON 388665871, KRS 0000893739.
- The Loyalty Program is intended for Customers of the www.petitepants.pl Store.
- Any Customer with an Account in the Store may participate in the Loyalty Program.
- Every Customer, upon taking steps to use the Loyalty Program, is obliged to comply with the provisions of these Regulations and the regulations of the www.petitepants.pl Online Store.
- The condition for joining and participating in the Loyalty Program for a Customer is having an Account in the Store, familiarizing themselves with these Regulations and accepting them.
- In matters not regulated by these Regulations, the provisions of the Online Store regulations operating at www.petitepants.pl, the provisions of the Civil Code, and other relevant provisions of Polish law shall apply.
§ 2 DEFINITIONS
- LOYALTY PROGRAM – the loyalty program of the www.petitepants.pl Store organized by the Organizer.
- REGULATIONS – these Loyalty Program regulations.
- STORE – the Organizer's online store operating at www.petitepants.pl.
- ORGANIZER – TBE Company Sp. z o.o., with its registered office at: ul. Jodłowa 3/5, 81-526 Gdynia, NIP 9562367791, REGON 388665871, KRS 0000893739.
- CUSTOMER – A Customer of the www.petitepants.pl Store, with an active Account.
- CONSUMER – a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity.
- ACCOUNT – a set of resources in the Organizer's ICT system, identified by an individual name (login) and password, where Customer data, including information about orders placed by them, is collected.
§ 3 RULES OF PARTICIPATION AND POINTS IN THE LOYALTY PROGRAM
- In order to join the Loyalty Program, the Customer interested in participating should perform the following actions:
- familiarize themselves with the basic information about the Loyalty Program available on the Store's website,
- register an Account in the www.petitepants.pl Store via the registration form, in accordance with the Store's regulations,
- read and accept these Regulations.
- The Organizer, through the Loyalty Program, enables Customers to collect points for products purchased in the Store.
- Points can be exchanged for discounts, which the Customer can use when placing subsequent orders in the Store. The exchange rate is: 100 PetitePoints = 1 PLN discount.
- The Customer, after joining the Loyalty Program, receives points for each sales contract concluded with the Organizer via the Store. Points are awarded to the Customer from the moment of joining the Loyalty Program and placing and paying for the first order in the Store.
- The Organizer will award the Customer 1 point for every zloty spent in the Store.
- Points are credited to the Customer's Account when the payment for the order is settled in the Organizer's bank account.
- PetitePoints received for a specific order are valid for 6 months from the date they are credited to the Customer's Account. After this period, the points expire and cannot be used in any way.
- Subject to point 7 of this paragraph, points earned by the Customer, entitling them to receive a discount, accumulate.
- The Customer can check the current level of their points after logging in to their Customer Account on the Store's website.
- Points are non-transferable.
- The Organizer has the right to deduct previously accrued points from the Customer:
- if the Customer terminates the sales contract concluded with the Organizer as a result of exercising the consumer's right to withdraw from the contract. In this situation, the Organizer deducts from the Customer's Account the number of points corresponding to the value of the returned products,
- if the Customer received points unduly.
- The Organizer is not liable to Customers for the loss of points due to technical problems.
§ 4 DURATION OF THE LOYALTY PROGRAM
- The Loyalty Program is introduced for an indefinite period from May 24, 2025.
- The Organizer reserves the right to suspend or terminate the Loyalty Program.
- Information about the suspension or termination of the Loyalty Program will be posted on the Store's website with at least one month's notice.
- In the event of termination of the Loyalty Program, unused points expire and cannot be used in any other way.
§ 5 TERMS OF WITHDRAWAL FROM PARTICIPATION IN THE LOYALTY PROGRAM
- The Customer may at any time, without giving any reason, withdraw from participation in the Loyalty Program by sending a relevant statement to the Organizer via e-mail to: kontakt@petitepants.pl or by selecting the appropriate option in the Account settings in the Store.
- In the event of withdrawal from the Program, the Customer loses all previously acquired points.
§ 6 COMPLAINT PROCEDURE
- Complaints related to the Loyalty Program can be submitted via e-mail to: kontakt@petitepants.pl
- In the above e-mail, as much information and circumstances regarding the subject of the complaint should be provided as possible, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Service Provider.
- The Service Provider shall consider the complaint immediately, no later than within 14 days from the date of its submission.
- The Service Provider's response regarding the complaint is sent to the Customer's e-mail address provided in the complaint or in another way indicated by the Service Provider.
§ 7 PERSONAL DATA
- The administrator of personal data collected in connection with the implementation of the provisions of these Regulations is TBE Company Sp. z o.o., with its registered office at: ul. Jodłowa 3/5, 81-526 Gdynia, NIP 9562367791, REGON 388665871, KRS 0000893739.
- The Administrator processes Customers' personal data for the purpose of implementing the Loyalty Program, based on art. 6 sec. 1 lit. b) GDPR (performance of a contract for the provision of services by electronic means in accordance with the Regulations).
- Customers' personal data are stored by the Organizer for as long as it is necessary to perform the contract and implement the Loyalty Program, and after that time for a period corresponding to the period of limitation of claims.
- Providing personal data by the Customer is voluntary.
- The Administrator takes special care to protect the interests of the data subjects, and in particular ensures that the data collected by him are:
- processed lawfully,
- collected for specified, legitimate purposes and not further processed in a manner incompatible with those purposes,
- substantively correct and adequate in relation to the purposes for which they are processed and stored in a form allowing identification of the data subjects, no longer than necessary to achieve the purpose of processing.
- The Customer's personal data may be disclosed to third parties only on the basis of legal provisions or appropriate contractual relations. Recipients of data may include: accounting offices, entities dealing with external IT systems, entities dealing with legal services, authorized state authorities.
- The Organizer processes Customers' data only within the European Economic Area.
- The user has the right to:
- Access to data – art. 15 GDPR,
- Rectification of data – art. 16 GDPR,
- Erasure of data (the so-called right to be forgotten) – art. 17 GDPR,
- Restriction of processing – art. 18 GDPR,
- Data portability – art. 20 GDPR,
- Object – art. 21 GDPR,
- Withdraw consent – art. 7 sec. 3 GDPR (where withdrawal of consent does not mean that processing before its withdrawal was unlawful).
- In order to exercise the rights referred to in point 8, a relevant request should be sent to the e-mail address kontakt@petitepants.pl.
- In the event that the processing of personal data violates the provisions of the GDPR, the data subject has the right to lodge a complaint with the President of the Personal Data Protection Office.
§ 8 FINAL PROVISIONS
- Changes made to the Regulations by the Organizer are binding for the Customer, provided that the Customer has been properly informed about the changes and has not terminated the contract for the provision of services by electronic means within 14 days from the date of notification of the changes.
- In the event of any part of the Regulations being inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the challenged provision of the Regulations.
- Any disputes between the Organizer and the Customer (Consumer) will be resolved primarily through negotiations, with the intention of amicably resolving the dispute. However, if this is not possible, or if it is unsatisfactory for either party, disputes will be resolved by the competent common court in accordance with the provisions of the civil procedure code of November 17, 1964.
- In relation to Customers who are not Consumers, the common court competent for the Organizer's registered office is competent to resolve disputes arising from the application of these Regulations.
